Civil litigation,
i.e. civil court action, is the method of resolving disputes or
claims between individuals, companies, local authorities and government
departments by court proceedings.
Civil Court action is now regarded as the last resort. Those involved in a dispute are expected to have followed certain procedures before starting a court claim (“pre action protocols”). Also, the parties are required to consider alternative dispute resolution ("ADR"). We can attempt a negotiated resolution to your dispute, but if that is not possible, then we will prepare and issue court action and take your case through to trial. We offer "No Win No Fee"
arrangements.

Injunctions
Mainly
litigation falls into two categories. One is
based on contract, and the other is based on a civil wrong caused by one
party to another either deliberately or negligently. The range of
disputes based on contract can vary from substantial commercial disputes
to wide ranging consumer disputes such as the purchase of a defective
item or a claim arising as as a result of poor
workmanship.
Generally, as costs are not usually recoverable where the
claim is worth £5,000 or less, it should usually be pursued 'in person'
in the small claims court. We could, however, for an agreed fee, prepare
the documentation to start the case off and advise you about the steps
to take along the way.
Civil wrongs include cases of personal
injury and damage to property and reputation - Landlord
and Tenant disputes are also a major cause of court actions.
If you are involved in a dispute with another individual or
company we can advise you on your chances of success and the possible
value of your claim - see ways
of funding a claim.
